1. General & Business Operations

• Splashsuits is an Australian registered business operating out of Sydney, New South Wales, Australia.

• We reserve the right to amend, update, or replace any part of these Terms and Conditions at our discretion without prior notice.

• We reserve the right to refuse service, limit order quantities, or cancel orders where fraudulent or unauthorized activity is suspected.

2. Pricing, Payments & Currency

• All prices displayed on Splashsuits.com.au are in Australian Dollars (AUD) and include Australian Goods and Services Tax (GST) where applicable.

• Product prices, promotional rates, and delivery charges are as published on the website at the time of purchase and are subject to change without prior notice.

• Payment must be made in full prior to order dispatch via our secure payment gateways and supported express checkout methods (such as Apple Pay and Google Pay).

3. Wholesale Orders & Childcare Tax Invoicing

• Volume discounts for bulk orders apply automatically at checkout as advertised on the website.

• Childcare centers, educational institutions, and commercial organizations requesting direct tax invoicing agree that all invoices must be settled in full within 14 days of issue.

• Splashsuits reserves the right to withhold shipment or suspend account privileges until outstanding invoice balances are cleared.

4. Shipping, Delivery & Risk

• All orders are dispatched from Sydney, Australia using our designated freight and courier partners.

• Estimated delivery timeframes provided at checkout are supplied by courier partners. Splashsuits is not responsible for transit delays caused by extreme weather, carrier disruptions, or incorrect shipping address details provided by the customer.

• Risk of loss or damage to items passes to the customer once the parcel has been delivered to the specified shipping address.

5. Returns, Size Exchanges & Consumer Guarantees

• Change of Mind & Size Exchanges: Unworn, unwashed items with all original packaging and tags intact may be returned for a size exchange or store credit within 14 days of delivery. The customer is responsible for all return shipping costs.

• Faulty Goods: Under Australian Consumer Law (ACL), our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. If an item is received damaged or defective, please submit a claim immediately via our contact form with your order details and photos of the fault.

6. Safe Use, Adult Supervision & Limitation of Liability

• Intended Use: Splashsuits are designed strictly as outdoor play overalls to keep children’s clothing clean and dry during everyday play. They are not personal protective equipment (PPE), safety wear, flotation devices, or flame-retardant garments.

• Mandatory Adult Supervision: Children wearing Splashsuits must be actively supervised by a responsible parent, legal guardian, or qualified educator at all times. Splashsuits accepts no liability for injuries, accidents, or adverse events occurring while a child is engaged in outdoor play or environmental exploration.

• Cap on Financial Liability: To the maximum extent permitted under the Competition and Consumer Act 2010 (Cth) and Australian Consumer Law, Splashsuits’ total aggregate financial liability for any claim, loss, injury, or damage arising from the purchase or use of our products shall not exceed the original purchase price paid for the product.

7. Intellectual Property

All website content—including brand names, logos, written text, imagery, graphics, and unique product design features (such as our 3D Dinosaur spikes, 3D Shark fins, and 3D Fairy wings)—is the protected intellectual property of Splashsuits. Unauthorized reproduction, copying, or distribution of any site content or product designs is strictly prohibited.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any legal disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
